Liability Waiver

AXE BLISS, LLC 

ASSUMPTION OF RISK AND RELEASE OF LIABILITY AGREEMENT 

I, ________________________________ (“Participant”), hereby voluntarily consent to participation in axe throwing and use of the facilities, (collectively the “Activities”) provided by Axe Bliss, LLC (“Axe Bliss”). In consideration of being permitted to participate in the Activities at Axe Bliss, I agree to the following assumption of risk and release of liability:

1. Acknowledgment of Rules. I have read and will follow any instructions or rules given to me or posted by Axe Bliss. I will inform Axe Bliss of any rule violations or dangerous behavior of other individuals. I acknowledge that Axe Bliss, in its sole discretion, has the authority to end my participation in Activities without a refund if my participation presents a danger to myself and/or others or if I fail to follow Axe Bliss instructions or rules.

2. Assumption of Risk. I acknowledge that the Activities, including axe throwing, are inherently dangerous and can involve many risks, including but not limited to splinters, cuts, fractures, slips, trips, falls, other serious physical injury, and death. I assume full responsibility for any risk of loss, property damage, bodily injury, death, or costs, including medical costs and attorney’s fees, arising out of or related to the Activities.

3. Release of Liability. In consideration of being permitted to participate in the Activities at Axe Bliss, I hereby voluntarily release, indemnify, and hold harmless Axe Bliss, its owners, agents, officers, board members, employees, and the premises owner, MRT Properties, LLC, from any and all claims, liability, loss, property damage, bodily injury, death, or costs, including medical costs and attorney’s fees, that might occur arising out of or related to the Activities, whether caused by the negligence of Axe Bliss, its owners, agents or employees, myself, or another participant.

4. Alcohol Use. I agree and understand all alcohol on the premises must be authorized and provided by the Facilitator and outside alcoholic beverages are not permitted on the premises. If I elect to consume alcohol prior to or during my participation in the Activities, I agree to assume all risk, known and unknown, related to consuming such alcohol and agree to be fully responsible and liable for any and all claims, demands, damages, losses, injuries, liabilities, obligations, costs or expenses of any kind which may arise due to my consumption of such alcohol (collectively the “Claims”). I hereby agree to indemnify, defend, and hold harmless the Facilitator Parties from any such claims.

5. Media Release. I hereby give Axe Bliss permission to photograph, videotape, or otherwise capture my image, appearance or likeness and to use such images for any legitimate purposes, commercial or otherwise. I waive any and all rights and claims against Axe Bliss, its owners, agents, officers, board members, and employees, arising out of or related to the use of my image or likeness, including claims related to defamation, copyright, invasion of privacy, publicity right, or compensation.

By signing below, I certify that I have read and understand this Assumption of Risk and Release of Liability Agreement and agree that I will be bound by its terms and conditions on my own behalf and on behalf of my representatives, executors, administrators, heirs and assigns. If signing this Assumption of Risk and Release of Liability Agreement on behalf of a minor child, I further certify that I am the parent and/or legal guardian of the minor child and that I agree that I will be bound by its terms and conditions on my own behalf and on behalf of the minor child, including my and/or the minor child’s representatives, executors, administrators, heirs and assigns.
